TDS for Small Business Owners: A Simple Guide That Won't Put You to Sleep
Confused about TDS? This plain-English guide covers TDS on rent, contractor payments, professional fees, and more — written specifically for small business owners in Rajasthan.
Let's be honest: TDS — Tax Deducted at Source — is one of those topics that business owners in Sanchore and Jalore either don't know about or actively avoid thinking about. Until they get a notice. Then it becomes very urgent, very fast.
If you pay rent, hire contractors, use professionals like architects or lawyers, or make certain payments to vendors, you may legally be required to deduct TDS before making those payments. Not knowing this doesn't protect you — it just means you're unknowingly non-compliant.
This guide is for you: the shop owner, the trader, the small manufacturer. No jargon. Just the facts you need.
Who Needs to Deduct TDS?
TDS is not just a corporate thing. If your business falls under any of the following, you have TDS obligations:
- ✓You run a firm, company, LLP, or HUF (Hindu Undivided Family)
- ✓You are an individual or proprietor whose accounts require a tax audit (typically, turnover above ₹1 crore for traders)
The TDS Sections Every Small Business Should Know
Section 194C — Payments to Contractors
If you hire someone to do contract work — printing, transport, catering, construction, or any kind of service contract — and the payment in a single transaction exceeds ₹30,000, or the total payments to that person in a year exceed ₹1 lakh, you must deduct TDS at 1% (individuals) or 2% (companies/firms).
This catches a lot of traders off guard. A furniture shop owner who pays a carpenter ₹80,000 for custom woodwork is technically paying a contractor — TDS applies.
Section 194J — Professional or Technical Fees
Payments to professionals like lawyers, architects, consultants, engineers, and technical experts attract 10% TDS if the total exceeds ₹30,000 in a year. So if you pay your architect ₹1.5 lakh for shop renovation drawings, deduct ₹15,000 as TDS before paying.
Section 194I — Rent
If you pay rent above ₹2.4 lakh per year (₹20,000 per month) for land, building, or furniture, TDS applies at 10% on the rent for buildings. This is where many shopkeepers — who pay significant rent for their commercial premises — are unknowingly non-compliant.
Section 194-IB — Rent for Individuals and HUFs
Even if you're a simple proprietor not subject to audit, if you pay rent above ₹50,000 per month, you must deduct 5% TDS on the entire rent in the last month of the year (or when vacating). This was specifically introduced for tenants of large commercial properties.
How Does TDS Actually Work — Step by Step
- ✓You agree to pay your consultant ₹1,00,000 for a service
- ✓You deduct 10% (₹10,000) before making the payment — so you pay them ₹90,000
- ✓You deposit the ₹10,000 with the government by the 7th of the following month
- ✓You file a quarterly TDS return (Form 26Q) with details of all TDS deducted
- ✓The consultant can see this credit in their Form 26AS and claim it when filing their ITR
TDS Return Deadlines — Don't Miss These
- ✓Q1 (April-June): Return due July 31
- ✓Q2 (July-September): Return due October 31
- ✓Q3 (October-December): Return due January 31
- ✓Q4 (January-March): Return due May 31
The 26AS — Your TDS Dashboard
Form 26AS is a consolidated tax credit statement maintained by the Income Tax Department. It shows every rupee of TDS deducted on your behalf — from clients who paid you, banks that deducted TDS on FD interest, and so on.
Every year before filing ITR, match your income records with your 26AS. If TDS was deducted on payments you received but isn't showing in 26AS, follow up with the deductor — they may not have filed their TDS return correctly. Unclaimed TDS credit is money left on the table.
